Under Indiana Code 5-23, BOT allows government units to:

- Enter a scoping period where schematic design and a guaranteed budget are developed.
- Only move forward if the design, financing, and budget are satisfactory.
- Cancel the process at no cost if expectations are not met.
- Begin construction with guaranteed financing and no risk of change orders.
